1) Access rules:
The facilities of CrossFit Bern GmbH, Bern, are available to men and women aged 16 and over during the course times published on the website. Persons suffering from contagious diseases are excluded from access to CrossFit Bern GmbH. Persons with open wounds may be refused entry by staff. Staff may also expel persons who impair the health of other members, hygiene or the proper provision of services by CrossFit Bern GmbH, Bern, may also be asked to leave by staff.
2) Services:
The membership contract is personal and cannot be transferred. CrossFit Bern GmbH, Bern, reserves the right to carry out checks in this regard. The fitness programme includes the services listed in the ‘Price List’ document. All additional services are not included in the price.
3) Opening hours:
CrossFit Bern GmbH, Bern, is open during the course times listed on the website. Individual parts of the facility may be closed for up to two weeks without entitlement to a refund. CrossFit Bern GmbH, Bern, reserves the right to change its offer and operating hours. In this case, the customer shall not be entitled to a refund.
4) Data storage:
The customer acknowledges that their arrival and departure times and data on their training success may be stored electronically. This data will not be passed on to third parties. If the contract is not renewed, this data will be deleted after two years.
5) Company policy:
All visitors undertake to follow the instructions of the staff and to strictly observe the hygiene regulations. Gross and repeated violations will result in expulsion from the premises. In this case, there is no entitlement to a refund of the amount already paid.
6) Terms of payment:
The respective membership fee is payable in advance in cash or by bank transfer. Invoices are due for payment in advance. They will be sent by email. A reminder fee of CHF 15.00 will be charged from the third reminder onwards.
7) Contract extension:
If the membership is extended without interruption after the contract period has expired, the terms and conditions and prices valid at the time shall apply to the new period.
8) Refund:
Non-use of the services of CrossFit Bern GmbH, Bern, does not entitle the member to a reduction or refund of the membership fee (in accordance with the Swiss Code of Obligations). Early withdrawal from the contract is only possible for one of the following reasons:
a) Chronic illness, disability or death.
If one of these reasons occurs, CrossFit Bern GmbH, Bern, will waive its right to continue the contract.
9) Suspension of subscription:
In certain cases, it is possible to suspend membership with credit for the interrupted period. The decision on suspension lies within the legal framework of CrossFit Bern GmbH, Bern. A request for break can be made in the form specified by CrossFit Bern GmbH, Bern, in the following cases:For holiday absences of 7 days or more. No more than 5 weeks of holiday per year (annual subscription period) can be claimed. For subscriptions with a term of 3 or 6 months, CrossFit Bern GmbH, Bern, will not grant more than 2 or 3 weeks of subscription break.
- In the event of illness or injury lasting 7 days or more, and only upon submission of the relevant medical certificates.
- In the event of pregnancy, upon submission of the relevant medical certificate.
- In the event of military service, only upon submission of the relevant marching orders.
- Only subscription breaks requested no later than one month after the absence will be considered.
- Subscription breaks will only be considered for current subscriptions. All holiday and absence entitlements expire upon expiry of a subscription. A subscription break does not entitle the customer to defer payment. Instalment payments for subscriptions are also due during a subscription break and must be paid on time in accordance with the contractual agreement, even if the service is not used at that time.
10) Force majeure:
If political or economic events, pandemics/epidemics, natural disasters, acts of war or general force majeure make it impossible or difficult to provide the usual services, the customer cannot make any claims for damages against CrossFit Bern GmbH, Bern, and the membership fee remains payable.
11) Changes:
We reserve the right to change the terms and conditions, offers and operating rules and will inform the customer of any changes in an appropriate manner.
12) Place of jurisdiction:
Bern.
